AGB
Effective Date: February 11, 2026
These Terms of Service (“Terms”) govern your access to and use of the Royal Optics website and related services (the “Services”), including purchases made by customers in Germany, Austria, Switzerland, and other supported regions.
By accessing the website or placing an order, you agree to be bound by these Terms.
1. Operator Information
This website is operated by Royal Optics (“we”, “us”, “our”).
Further legal information about the company, including registered address and contact details, is provided in the Legal Notice / Impressum section.
2. Scope of Application
These Terms apply to all contracts concluded between Royal Optics and consumers purchasing products through this website.
Conflicting terms of the customer shall not apply unless expressly agreed in writing.
3. Eligibility
You must be at least 18 years old or have authorization from a legal guardian to place an order.
You agree to provide accurate and complete information when placing an order.
4. Conclusion of Contract
Product listings on the website constitute a non-binding invitation to submit an offer.
By placing an order, you submit a binding offer to purchase the selected product.
A contract is concluded only when we expressly confirm acceptance of the order (e.g., by shipping confirmation email).
5. Prices and Payment
All prices are displayed in Euros (EUR €), unless otherwise stated, and include applicable VAT where required by law.
Additional shipping costs are displayed during checkout.
Payment is processed through secure third-party providers, including Shopify Payments.
We reserve the right to refuse or cancel orders in cases of:
-
Pricing errors
-
Fraud suspicion
-
Unauthorized transactions
-
Abuse of policies
6. Delivery
Delivery times are estimates and are provided in the Shipping & Delivery Policy.
For consumers within the EU, the risk of loss passes to the consumer upon delivery of the goods.
For cross-border shipments (e.g., Switzerland), customs duties and import charges may apply and are the responsibility of the customer.
7. Right of Withdrawal
Consumers residing in the EU (including Germany and Austria) have a statutory 14-day right of withdrawal.
Details regarding the exercise of this right and its effects are set out in our Refund & Returns Policy.
Nothing in these Terms limits mandatory consumer rights under applicable law.
8. Warranty (Gewährleistung)
Statutory warranty rights apply in accordance with applicable laws in Germany and Austria.
This includes rights in cases of defective goods.
For Swiss customers, applicable Swiss consumer protection laws apply.
9. Intellectual Property
All content on this website — including trademarks, logos, images, text, graphics, and product descriptions — is protected by intellectual property laws.
Any unauthorized reproduction or use is prohibited.
10. Prohibited Use
You agree not to:
-
Use the website for unlawful purposes
-
Interfere with system security
-
Attempt unauthorized access
-
Submit fraudulent orders
-
Abuse refund or dispute mechanisms
We reserve the right to suspend access in case of violation.
11. Limitation of Liability
We are liable without limitation for:
-
Intentional misconduct
-
Gross negligence
-
Injury to life, body, or health
In cases of slight negligence, we are liable only for breach of essential contractual obligations (cardinal obligations), and liability is limited to foreseeable damages typical for the contract.
Mandatory statutory liability remains unaffected.
(This structure is important for Germany — broad liability exclusions are invalid.)
12. Force Majeure
We shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including:
-
Natural disasters
-
Government measures
-
Customs delays
-
Carrier disruptions
13. Governing Law
These Terms are governed by the laws of the country in which Royal Optics is legally registered.
If you are a consumer residing in Germany, Austria, or another EU country, mandatory consumer protection provisions of your country of residence remain applicable.
For Swiss customers, Swiss mandatory consumer law provisions apply where required.
14. Dispute Resolution
The European Commission provides an online dispute resolution (ODR) platform:
https://ec.europa.eu/consumers/odr/
We are not obliged and do not agree to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.
15. Severability
If any provision of these Terms is held invalid, the remaining provisions remain in effect.
